8. Jurisdiction and Applicable Law
- Application of laws: Legal relations arising from the use of applications, consulting services, and cybersecurity solutions will be governed by international laws on intellectual property, cybersecurity, and digital commerce. In addition, the user’s local laws, according to their jurisdiction, will apply on a complementary basis to the extent permitted by private international law.
- Primary jurisdiction: Since the main headquarters of EmeritaCode is in Macau, any legal dispute related to contracts, services, or the use of our applications will initially be subject to the legal provisions in force in this region, including applicable local laws such as the Lei da Criminalidade Informática and the Lei da Proteção de Dados Pessoais.
- Branch in Spain: For users or clients located in Europe, particularly in Spain, legal relations will also be subject to relevant Spanish regulations, such as the Ley Orgánica 10/1995 del Código Penal, the LSSI-CE, and the GDPR, regarding cybersecurity, digital commerce, and data protection.
- Alternative mechanisms: Before resorting to judicial instances, the parties may opt for alternative dispute resolution mechanisms, such as mediation or arbitration, in accordance with applicable international and local regulations. These mechanisms will be available both at the main headquarters in Macau and at the branch in Spain.

Preferred forum: For legal disputes that cannot be resolved through alternative mechanisms, the parties agree to submit, as applicable, to:
